NakibVPS is committed to complying with U.S. copyright law and responding promptly to clear notices of alleged copyright infringement. We have registered a Designated Agent with the U.S. Copyright Office as required by the DMCA. We will respond expeditiously to claims of copyright infringement committed using our services that are reported to our Designated Agent, as described below.

If you are a copyright owner, or authorized to act on behalf of one, and you believe that your copyrighted work has been copied and made accessible through NakibVPS services in a way that constitutes copyright infringement, you may submit a notification pursuant to the DMCA by providing our Designated Agent with the following information in writing:

Your notification must include all of the following elements to be effective: 1. Identification of the Copyrighted Work: A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, you may provide a representative list of such works. 2. Identification of the Infringing Material: Identification of the material that you claim is infringing and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. Please provide specific URLs where the allegedly infringing material can be found. 3. Your Contact Information: Your name, mailing address, telephone number, and email address. 4. Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law. 5. Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. 6. Signature: A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner.

Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees. Before submitting a DMCA notice, please carefully consider whether the use of the copyrighted material at issue is protected by the "fair use" doctrine, as you could be liable for damages if you make a false claim.

Upon receipt of a valid DMCA takedown notice, NakibVPS will: 1. Acknowledge Receipt: Send a confirmation to the complainant acknowledging receipt of the notice 2. Review the Notice: Verify that the notice contains all required elements 3. Take Action: If the notice is complete and valid, we will expeditiously remove or disable access to the allegedly infringing material 4. Notify the User: Notify the customer or user who posted the allegedly infringing material that we have removed or disabled access to the material 5. Provide Counter-Notice Information: Inform the affected user of their right to submit a counter-notification We aim to process valid DMCA notices within 24-48 hours of receipt during business days.

If you are a NakibVPS customer and you believe that your material was removed or disabled by mistake or misidentification, you may file a counter-notification with our Designated Agent.

Your counter-notification must include all of the following elements: 1. Identification of the Material: Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled (please provide specific URLs). 2. Your Contact Information: Your name, mailing address, telephone number, and email address. 3. Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, the Federal District Court for the District of Wyoming), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person. 4. Good Faith Statement: A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled. 5. Signature: Your physical or electronic signature.

Upon receipt of a valid counter-notification, NakibVPS will: 1. Forward to Complainant: Promptly provide the original complainant with a copy of the counter-notification 2. Inform of Timeline: Inform the complainant that we will restore the removed material in 10-14 business days unless we receive notice that the complainant has filed a court action seeking to restrain the alleged infringer 3. Restore Material: If we do not receive notice of a court action within 10-14 business days, we will restore the material to its original location

In accordance with the DMCA and other applicable laws, NakibVPS has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers.

A user may be considered a "repeat infringer" if they: - Have been the subject of more than two (2) valid DMCA takedown notices - Have had material removed more than twice for copyright infringement - Have submitted counter-notifications that were subsequently determined to be invalid or made in bad faith

The following activities are strictly prohibited on NakibVPS services: - Hosting, distributing, or linking to pirated software, movies, music, e-books, or other copyrighted content - Operating torrent trackers or indexes for copyrighted content - Hosting "warez" sites or file-sharing services for copyrighted material - Streaming copyrighted content without authorization (movies, TV shows, sports events, etc.) - Hosting IPTV services that distribute copyrighted broadcasts - Operating "cyberlocker" or file hosting services used primarily for copyright infringement - Hosting counterfeit goods or services that infringe trademarks - Using automated tools to scrape or copy copyrighted content from other websites - Operating cardsharing or satellite/cable descrambling services - Hosting ROM sites, emulator downloads, or pirated video game content Engaging in any of these activities may result in immediate account termination without notice or refund.

NakibVPS qualifies for the safe harbor protections provided under Section 512 of the DMCA for service providers. As a service provider: - We do not have actual knowledge of infringing material on our network unless properly notified - We do not receive a financial benefit directly attributable to infringing activity where we have the right and ability to control such activity - We respond expeditiously to remove or disable access to material upon receiving proper notification of claimed infringement - We have designated an agent to receive notifications of claimed infringement and registered that agent with the U.S. Copyright Office

While the DMCA specifically addresses copyright infringement, NakibVPS also takes trademark infringement seriously. If you believe that content hosted on our services infringes your trademark rights, please contact us at abuse@nakibvps.com with the following information: - A description of your trademark (word mark, logo, etc.) - Trademark registration number and jurisdiction (if registered) - Evidence of your trademark rights - Identification of the allegedly infringing content with specific URLs - An explanation of how the content infringes your trademark rights - Your contact information We will review trademark complaints and take appropriate action, which may include removing content or suspending accounts.

As a NakibVPS customer, you are responsible for: - Ensuring that all content you upload, host, or distribute through our services does not infringe the copyrights, trademarks, or other intellectual property rights of any third party - Obtaining all necessary licenses, permissions, or authorizations for any copyrighted content you use - Responding promptly to any infringement notices we forward to you - Removing infringing content immediately upon becoming aware of an infringement - Indemnifying NakibVPS against any claims arising from your infringement of third-party intellectual property rights

Please note the following limitations: - NakibVPS cannot provide legal advice regarding copyright, fair use, or intellectual property matters - We are not responsible for determining the validity of copyright claims and act in accordance with the DMCA upon receiving compliant notices - Disputes between copyright owners and alleged infringers must ultimately be resolved through the legal system - This policy applies only to content hosted on NakibVPS services; we cannot act on content hosted by third parties

NakibVPS reserves the right to modify this Copyright Infringement Policy at any time. Changes will be effective immediately upon posting to our website. We will update the "Last Updated" date at the top of this policy when changes are made. Your continued use of our services after any modification constitutes acceptance of the updated policy.
